Acceptance of These Terms

By downloading, installing, or using any application published by mkb0020 Studios (an application, "app," or "the software"), you agree to these Terms & Conditions. If you don't agree, please don't use the software.

License to Use the Software

The compiled applications distributed through the Microsoft Store, itch.io, or mkb0020 Studios' own website are provided to you under a personal, non-exclusive, non-transferable, revocable license to install and use them for your own personal or professional purposes.

Open Source

Where the source code for an application is publicly available (for example, on GitHub), it is separately licensed under the MIT License unless a different license is noted in that repository. The MIT License is a permissive open-source license: it allows you to use, copy, modify, merge, publish, distribute, sublicense, and sell copies of the source code, provided the original copyright notice and license text are included with any substantial portion of it.

Being open source does not mean the code is unowned or in the public domain -- mkb0020 Studios retains copyright ownership and authorship of all source code it publishes. The MIT License is a broad grant of permission from that ownership, not a transfer of it.

The mkb0020 Studios name, logo, and branding, and any artwork or design assets bundled with an application, are not covered by the MIT License unless explicitly stated, and remain the property of mkb0020 Studios. You may not:

Free Forever, Value-for-Value

Every application published by mkb0020 Studios is free to download and use, with no trial period, paywall, or required purchase. Apps currently offered for free will not be moved behind a paywall in the future.

Some apps include an optional "Support this project" feature, described below. Using this feature is never required to access any functionality of the software.

Optional Support Payments

If you choose to send an optional support payment, that payment is processed securely by Stripe. mkb0020 Studios does not receive or store your card information -- see our Privacy Policy for details on what information is stored.

Support payments are voluntary contributions, not purchases of a product or service, and are generally non-refundable. If you believe a payment was made in error, contact us and we'll do our best to help.

No Warranty

The software is provided "as is" and "as available," without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. mkb0020 Studios does not guarantee the software will be error-free, uninterrupted, or free of vulnerabilities.

Limitation of Liability

To the maximum extent permitted by law, mkb0020 Studios is not liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the software, including but not limited to loss of data, loss of profits, or business interruption -- even if advised of the possibility of such damages.

mkb0020 Studios applications may be distributed through platforms including the Microsoft Store and itch.io, and may rely on third-party services including Stripe, GitHub, and Vercel. Your use of those platforms and services is also governed by their own terms:

Termination

You may stop using the software at any time by uninstalling it. mkb0020 Studios reserves the right to discontinue or modify any application at any time, though apps already offered for free will remain free for as long as they're offered.

Changes to These Terms

These Terms & Conditions may be updated as new applications and features are released. The latest version will always be available on this page.

Governing Law

These terms are governed by the laws of the jurisdiction in which mkb0020 Studios operates, without regard to conflict of law principles.
